NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE PRIVATE Premises: 4 Walker Street, North Adams, Massachusetts By virtue and in execution of the Power of Sale contained in a certain mortgage given by Constance C. Lavigne to Hoosac Bank, said mortgage dated April 18, 2013, and recorded in the Berkshire County (Northern District) Registry of Deeds, in Book 1509 at Page 383 and now held by MountainOne Bank f/k/a Hoosac Bank, for breach of the conditions in said mortgage and for the purpose of foreclosing the same, will be sold at Public Auction on May 24, 2023 at 12:00 PM Local Time upon the premises, all and singular the premises described in said mortgage, to wit: The land situated in said North Adams, at the comer of Walker Street, formerly called the Stamford Road and East Main Street, formerly called the Florida Road, bounded and described as follows: Beginning at a stake and stones at the northeast corner of the intersection of said Florida Road and said Stamford Road; thence south 69 1/2 degrees east along the north side of said Florida Road 9 1/2 rods to a point; thence north 19 degrees east 3 5/6 rods to a point; thence westerly parallel to said first course 9 1/2 rods to said Stamford Road; thence southerly along said Stamford Road 3 5/6 rods to the place of beginning. Containing 36.4 square rods, more or less and being the same premises conveyed by deed Euclid J. Lebert to Marie Lebert dated January 3, 1917, recorded in Northern Berkshire Registry of Deeds in Book 319, page 401. EXCEPTING, however, from and out of the above described premises the strip of land taken by the City of North Adams for highway purposes, by taking recorded in Northern Berkshire Registry of Deeds, December 19, 1939, Book 433, Page 68, to which taking and the record thereof reference is always to be had for a more detailed description thereof. Being the same premises conveyed to Ralph L. Lavigne and Constance C. Lavigne by deed of Florence Beaton by her Attorney in Fact Norman E. Martin dated March 17, 1995 and recorded with Northern Berkshire Registry of Deeds in Book 895, Page 565. The said Ralph L. Lavigne died on June 19, 2003. See M.G.L. Chapter 65-C Affidavit with copy of his Death Certificate attached thereto, recorded with said Registry of Deeds simultaneously herewith. The description of the property that appears in the mortgage to be foreclosed shall control in the event of a typographical error in this publication. For Mortgagors' Title see deed dated March 17, 1995, and recorded in Book 895 at Page 565 with the Berkshire County (Northern District) Registry of Deeds. TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. Other terms to be announced at the sale.
